What is a foreclosure?

Notice of Default: When a borrower is 120 days behind on their mortgage, the lender sends the data to a neutral third party called the Trustee to file a Notice of Default (“NOD”). The notice is mailed as well as posted on the front door of the house. The amount on the NOD is past due payments, late fees and any legal and filing fees.

Notice of Trustee Sale” The Notice of Trustee Sale (“NTS”) If the default is not cured, the Trustee files an NTS. This is filed at least 20 days before the auction on the courthouse steps. These notices are also mailed and posted on the door.

 

Best time to sell if the borrower can’t pay?

The best time list is before the NOD is actually recorded. Once the NOD is recorded, the world is on notice and all of the opportunists come out to make low offers so they can make a profit off the resale. The worst time to sell is when the NTS is filed. Now that you are marching towards the courthouse steps, you may run out of time to close your sale. Leaving the cash buyers with their low offers.
